Rite Aid Agrees to Ban Facial Recognition Technology Following FTC Settlement

Rite Aid, a well-known chain of pharmacies and stores, has recently agreed to a five-year ban on using facial recognition technology. This decision comes after the Federal Trade Commission (FTC) found that the company had falsely accused customers of crimes and unfairly targeted people of color. The settlement between the FTC and Rite Aid was reached on Tuesday, following a complaint that alleged the use of artificial intelligence-based software to identify individuals deemed likely to engage in shoplifting or other criminal behavior.

Unfortunately, the imperfect facial recognition technology led to false-positive alerts, resulting in customers being wrongly identified as criminals. In some instances, Rite Aid employees even publicly accused people of criminal activity in front of their friends, family, and complete strangers. This has caused immense humiliation and harm to innocent individuals who were wrongfully detained and subjected to searches.

In response to the settlement, Rite Aid stated that it is “pleased to reach an agreement” with the FTC, but it fundamentally disagrees with the facial recognition allegations in the agency’s complaint. The FTC’s legal filing contains customer complaints spanning from 2012 to 2020, showcasing the extent of the false accusations and unfair targeting. Rite Aid’s facial recognition software was primarily deployed in neighborhoods with large Black, Latino, and Asian communities, further exacerbating concerns of racial bias and discrimination.

Samuel Levine, the director of the FTC’s Bureau of Consumer Protection, emphasized the seriousness of Rite Aid’s actions, stating that the company’s reckless use of facial surveillance systems left its customers facing humiliation and other harms. Levine also highlighted the violation of consumer privacy, as Rite Aid’s order violations put sensitive information at risk.

As part of the settlement, Rite Aid will be required to implement comprehensive safeguards to prevent harm to its customers when deploying AI-based technology in its locations. Furthermore, the company will not be allowed to use such technology if it cannot control potential risks to consumers. Rite Aid stated that the safety of its associates and customers is of paramount importance and that it will continue to enhance and formalize the practices and policies of its comprehensive information security program.

The pilot program that used facial recognition technology involved creating a database of thousands of low-quality pictures from store cameras and employees' phones. These pictures were labeled as “persons of interest” based on Rite Aid’s belief that these individuals were involved in criminal activity within their stores. The FTC is now requiring Rite Aid to delete these pictures and notify customers that their images were included in the database.

It is important to note that since Rite Aid is currently engaged in bankruptcy proceedings, the orders from the FTC will go into effect after approval from the courts. It remains to be seen how the company will navigate these challenges and ensure that the rights and privacy of its customers are protected moving forward.
