New Policies on Responsible AI Use by DHS

The Department of Homeland Security (DHS) has recently released new policies focused on responsible artificial intelligence (AI) use to advance its missions. According to DHS Secretary Mr. Mayorkas, “Artificial intelligence is a powerful tool we must harness effectively and responsibly.” The new policies specifically address the use of facial recognition and face capture technologies, ensuring that they undergo extensive testing and oversight to minimize unintended bias or disparate impact. The policies also grant U.S. citizens the right to opt-out of face recognition for certain non-law enforcement uses. Additionally, face recognition cannot be the sole basis for any law or civil enforcement actions.

The new policies also establish a process for oversight offices within DHS, including the Privacy Office, the Office for Civil Rights and Civil Liberties, and the Office of the Chief Information Officer, to review all new uses of face recognition and face capture technologies. DHS emphasizes its rapid adoption of AI to advance various missions, such as combating fentanyl trafficking, strengthening supply chain security, countering sexual exploitation, and protecting critical infrastructure. In line with these efforts, DHS has appointed Eric Hysen as its first chief AI officer. Hysen, who also serves as the Chief Information Officer, will promote AI innovation and safety within the department.
