In a thought-provoking lecture delivered on Monday, Chief Justice of India, D Y Chandrachud, expressed his belief that Artificial Intelligence (AI) has the potential to revolutionize criminal investigations. According to him, AI, with its ability to analyze vast amounts of data rapidly, can act as a game-changer for law enforcement agencies like the Central Bureau of Investigation (CBI), allowing them to identify trends, anomalies, and potential leads with unprecedented accuracy.

Chief Justice Chandrachud drew a parallel between AI in criminal investigations and a scene from the movie “Minority Report.” In this futuristic society, AI is portrayed as a tool for predicting future crimes, enabling law enforcement to intervene before they occur. The Chief Justice emphasized that AI aids in the de-complexification of crimes and assists in breaking down intricate cases into manageable components for analysis and resolution.

The COVID-19 pandemic has served as a catalyst for the digitization of criminal processes. Chief Justice Chandrachud noted that the crisis highlighted the need for seamless connectivity within the criminal justice system, leading to the widespread adoption of virtual courts and e-registries. However, he also raised concerns about the potential drawbacks and shortcomings of complete digitization. He pointed out that while it promises increased efficiency and accessibility, there is a risk of excluding individuals without internet access or technological proficiency, which is still a significant portion of India’s population.

“The imperative is to ensure a delicate balance between the search and seizure powers vested with investigative agencies like the CBI and an individual’s right to privacy,” Chief Justice Chandrachud emphasized. This delicate balance is crucial to harness the potential benefits of AI in criminal investigations while respecting individuals' fundamental rights.
