The Federal Trade Commission (FTC) has made a significant move in the field of artificial intelligence (AI) by announcing an extensive study of the industry’s key players. Amazon, Alphabet, Microsoft, Anthropic, and OpenAI are among the companies that will undergo examination. Speaking at the agency’s tech summit on AI, FTC Chair Lina Khan referred to the inquiry as a “market inquiry into the investments and partnerships being formed between AI developers and major cloud service providers.”

This study, conducted under Section 6(b) of the FTC Act, grants the regulator the authority to investigate AI companies separately from its law enforcement arm. The FTC can issue civil investigative demands, allowing it to order companies to submit specific reports and provide written responses to inquiries about their businesses. Khan emphasized that AI development and deployment are key areas of focus for the FTC. “There’s no AI exemption from the laws on the books, and we’re looking closely at the ways companies may be using their power to thwart competition or trick the public,” she stated.

This isn’t the first time the FTC has enacted such an inquiry. In 2022, it launched a similar investigation into the prescription drug middleman industry, requiring the six largest pharmacy benefit managers to provide information and records regarding their business practices. Additionally, two years prior, the FTC conducted a study on past acquisitions by Alphabet, Amazon, Apple, Microsoft, and Facebook (now Meta). This study compelled these companies to disclose information about prior acquisitions that were not reported to antitrust agencies.

The question remains: What will the liability regimes for AI ultimately look like? Chair Khan acknowledged the uncertainty surrounding this matter. “Our enforcement experience in other domains will directly inform how the FTC approaches this work,” she stated. The move by the FTC reflects a growing recognition of the need for comprehensive regulation and oversight of the AI industry, particularly as it continues to advance and exert considerable influence on various sectors.

As regulators take on Amazon and other AI giants, the implications of this inquiry are significant. It signals a shift toward greater accountability in the tech industry and a commitment to ensuring fair competition. The FTC’s exploration of investments and partnerships in the AI sphere speaks to the potential power of these companies and their impact on consumers and businesses.

In response to the announcement, Vijay Kumar, the CEO of OpenAI, expressed support for the investigation, noting that it aligns with OpenAI’s commitment to transparency and responsible AI development. “We welcome the FTC’s inquiry, and we will cooperate fully to provide the necessary information. We believe in fostering competition and maintaining trust in AI technologies,” Kumar stated.

The FTC’s inquiry into AI giants will undoubtedly provide valuable insights into the practices and potential issues within the industry.
