Italian City Fined for Violating Data Protection with AI Surveillance

In a groundbreaking move, the northern Italian city of Trento has been fined €50,000 ($54,225) by Italy’s privacy watchdog for violating data protection regulations in its use of artificial intelligence (AI) in street surveillance projects. This marks the first time a local administration in Italy has faced sanctions from the GPDP watchdog for its use of AI tools.

The GPDP, known for its proactive approach to assessing AI platforms' compliance with data privacy regulations in the European Union (EU), was spurred into action after banning the popular chatbot ChatGPT in Italy last year and questioning the Italian Interior Ministry’s facial recognition system’s compliance with privacy laws. These instances, along with the rapid advancements in AI across various industries, have brought privacy concerns and the safety of personal data into sharper focus.

Following an extensive investigation into Trento’s projects, the GPDP found “multiple violations of privacy regulations,” citing inadequate anonymity of collected data and improper sharing of data with third parties. While acknowledging the municipality’s good intentions, the watchdog ordered the deletion of all data gathered in two EU-funded projects. In response, the municipality expressed its consideration of appealing the decision, stating, “The decision by the regulator highlights how the current legislation is totally insufficient to regulate the use of AI to analyze large amounts of data and improve city security.”

The timing of this incident is notable, as Italy’s government, led by Prime Minister Giorgia Meloni, aims to place a significant focus on the AI revolution during its presidency of the G7 major democracies. In December, EU lawmakers and governments reached provisional terms for regulating AI systems like ChatGPT, inching closer to establishing comprehensive rules governing the technology. One particular point of contention was the use of AI in biometric surveillance.

This development in Trento serves as a reminder that technological advancements, while promising great societal benefits, should always be accompanied by robust safeguards to protect privacy and personal data.
